Tradução de “Arbitragem como um termo do Direito Internacional”, de Thomas W. Balch, 1920

Resumo: A obra trata de esclarecer zona cinzenta acerca dos conceitos de arbitragem internacional, mediação e bons ofícios por parte de diplomatas, situação que, à época do trabalho original, permeava as disputas encampados pelos Estados, ao lado dos judiciários estatais. Thomas Willing Balch parte dos casos Alabama Claims e Bering Sea Fur Seal Fisheries para desenvolver seu raciocínio, analisa a evolução do conceito de arbitragem para os lexicógrafos norte-americanos e ingleses do seu tempo, bem como no pensamento de juristas renomados. Na presente tradução, inédita à língua portuguesa, foram mantidas originais as estruturas dos períodos, identificações dos casos e notas de rodapé.

Abstract: The original work tries to clarify the gray area about the concepts of international arbitration, mediation and good offices by diplomats, a situation that, at the time of the original work, permeated the disputes taken over by the States, alongside the state judiciaries. Thomas Willing Balch starts from the Alabama Claims and Bering Sea Fur Seal Fisheries cases to develop his reasoning, analyzes the evolution of the concept of arbitration for the North American and English lexicographers of his time, as well as in the thinking of renowned jurists. In the present translation, unpublished in Portuguese, the structures of the periods, case identifications and footnotes were kept original.
